New Kentucky Auto No‑Fault Threshold Effective July 15, 2026: What Insurers Need to Know About the Revised Rejection Form

KY| The Kentucky Department of Insruance Bulletin 2026-04 announces that, effective July 15, 2026, House Bill 627 increases Kentucky’s basic reparation (no‑fault) benefits for work loss, survivor’s economic loss, replacement services, and survivor’s replacement services from $200 to $500 per week, and explains how this change impacts the Kentucky No‑Fault Rejection Form used by individuals who choose not to limit their tort rights under KRS 304.39‑060(4). The Department of Insurance is pursuing an amendment to 806 KAR 39:030 so the regulation and incorporated No‑Fault Rejection Form align with the new benefit level, but because that rulemaking will not be effective by July 15, 2026, the Department is issuing an updated rejection form for interim industry use. All insurers issuing auto insurance in Kentucky are encouraged to use the attached updated form and to notify their agents, employees, and related entities of HB 627’s changes and the recommended form usage.
