Kentucky Bars Use of Satellite Imagery Alone for Policy Cancellations and Claim Denials

KY| Kentucky Department of Insurance Bulletin 2026-01 advises that property and casualty insurers may not use satellite imagery as the sole basis for cancellation, nonrenewal, or claim denial because it does not constitute a reasonable investigation under KRS 304.12-230 and KRS 304.20-320, and may not be paired solely with any prohibited reasons under KRS 304.20-340. Aerial imagery (e.g., drone or aircraft photos) may support adverse action only if it is clear, dated within the last 12 months, and accompanied by a written summary that identifies specific property conditions violating underwriting guidelines; low-quality or outdated images cannot justify adverse action. Neither satellite nor aerial images showing only roof streaking or discoloration are sufficient on their own to support adverse action, and insureds are entitled to review all images relied upon, with insurers encouraged to share imagery proactively and allow insureds an opportunity to dispute or show repairs. Insurers using artificial intelligence to analyze such imagery are directed to comply with the Department’s prior guidance in Bulletin 2024-02 on AI in insurance.
