Attention Health Insurers: New Guidance Issued on Hearing Officer Compensation

NM| New Mexico OSI Bulletin 2026-007 rescinds prior guidance and updates the rules for compensating hearing officers and co-hearing officers presiding over managed health care hearings under 13.10.16 and 13.10.17 NMAC, confirming that they will continue to be paid 350 dollars per hour plus New Mexico gross receipts tax for work on a grievance—including preparation, conducting the hearing, post-hearing deliberations, and issuing recommendations to the Superintendent—up to a maximum of eight hours per hearing, while clarifying that no compensation is available if the parties provide written notice of settlement at least three days before the scheduled external review hearing, and directing questions to the OSI Managed Health Care Bureau.
