URGENT: Utah Public Adjusters: Your Contract Forms Must Be Refiled — New Rules Now in Effect

UT| Utah Insurance Department Bulletin 2026-4 notifies public adjusters and public adjuster organizations that significant amendments to Utah Code § 31A-26 Part 4 and Utah Admin. Code R590-274 impose new requirements on the contracts they use. Because a contract form cannot legally be used until it has been filed with the Department, public adjusters must refile compliant contract forms (emailed to pcforms@utah.gov per R590-274-5) before conducting any new business in Utah, and should conduct a full review of the broader statutory and rule changes.

  • New contract disclosures required: Contracts must carry a prominent top-of-first-page disclosure stating the insured is not required to enter the contract to file a claim and will be charged a fee; a standalone disclosures page listing all R590-274-7(2) statements with a signed, dated insured acknowledgement; and all compensation language consolidated onto a single page.
  • Mandatory refiling before new business: Since forms must be on file before use, adjusters must submit updated, compliant contract forms to the Department before writing new Utah business.
