Nebraska DOI Greenlights Use of Insurance Consultants for Medicare Advantage Sales—With Key Conditions on Fees and Compliance

NE| The Nebraska Department of Insurance issues advisory Guidance Document IGD-B9 to clarify that insurance consultants may be used to sell Medicare Advantage plans in Nebraska, in light of some carriers reducing or removing producer commissions. Consultants differ from producers because they charge consumers a reasonable fee for advice and placement instead of receiving carrier commissions, and CMS had previously disallowed their use for Medicare Advantage under federal rules. CMS has now indicated to the Department that the permissibility of consultants is a matter of state law, so the Department will not prohibit their use as long as Nebraska’s consultant statutes are followed, all Medicare Advantage marketing and related federal and state rules are observed, and any consultant fee charged is reasonable.
