Colorado Amended Bulletin B-10.004: No Quant Testing Description Required in Annual Reports (For Now)

CO| The Amended Bulletin B-10.004 clarifies that, because the Colorado Division of Insurance has not yet adopted regulations specifying quantitative testing standards under Regulation 10-1-1, life insurers, private passenger auto insurers, and health benefit plan insurers using external consumer data are not currently required to include a description of quantitative testing to detect unfair discrimination in their annual reports (due December 1 for life and July 1 for auto and health); this waiver of the Section 5.A.11 reporting element remains in effect for each line of business until quantitative testing regulations are formally adopted, while all other provisions of Regulation 10-1-1 continue to apply to all authorized carriers in those lines, and the bulletin, issued October 18, 2024 and reissued June 10, 2026, is expressly characterized as interpretive guidance rather than a binding norm.
