Texas Department of Insurance Issues Bulletin Regarding Compliance with Senate Bill 1238

TX| On September 29, 2025, the Texas Department of Insurance reminded insurers, including HMOs, of the requirements of Senate Bill 1238, which amends Insurance Code Section 544.002 to prohibit discrimination against widowed individuals. Insurers may not refuse coverage, limit benefits, or charge different rates based on widowhood when compared to married individuals. All insurance policies delivered, issued, or renewed on or after September 1, 2025, must comply, and insurers may need to update their forms, rates, and underwriting guidelines to ensure adherence.
