Property & Casualty Insurers: New Louisiana Procedure Helps Shield Trade Secrets in Rate Filings

LA| Bulletin 2025-06 from the Louisiana Department of Insurance informs authorized P&C insurers that, effective with implementation of Act 11 (2025), an optional rate filing process is available allowing companies to submit an affidavit identifying specific rate, supplementary, or supporting documents they claim as confidential, proprietary, or trade secret, along with the legal basis for that status. LDI will review those designations and, if it concurs, issue an attestation to be included in the rate filing, and such materials may be excluded from public inspection under La. R.S. 22:1464. The bulletin also announces that the “Affidavit Certifying Confidential, Trade Secret, or Proprietary Information” form is now posted on the LDI website and provides contact information for questions to the Office of Property and Casualty.
