TX| Texas Department of Insurance Commissioner’s Order No. 2026-9844 approves NCCI Item B-1451, which amends the NCCI Basic Manual in Texas to establish workers compensation classification code 8871 for clerical telecommuter employees whose duties are clerical, who telecommute at least 50% of the time, and whose employers basic classification does not already include clerical employees, initially assigning code 8871 the same loss costs and rating values as code 8810 until it develops its own experience.
The Texas Department of Insurance gave public notice, received one supportive comment from Texas Mutual Insurance Company requesting broader use of 8871 for certain out-of-state telecommuters, and declined that recommendation to avoid inconsistency with standard exception classification rules and differing treatment of similar risks by state. The commissioner concludes TDI has jurisdiction, the amendments are consistent with Insurance Code Chapters 2051 and 2053 and Article 5.96, and orders that the changes apply to new and renewal policies effective on or after 12:01 a.m. July 1, 2026.
