DE| Delaware Domestic and Foreign Insurers Bulletin No. 134, revised in March 26, 2026, reminds all insurance carriers that effective January 1, 2024, they must provide coverage for an annual behavioral health well check pursuant to House Bill 303, which added identical sections 3370E and 3571Z to Title 18 of the Delaware Insurance Code requiring this benefit. The bulletin explains that carriers must reimburse providers for these services under the specific CPT codes listed in HB 303 (9938199387 and 9939199397) and at the same rates these codes are reimbursed for other medical care, allowing adjustments for nonphysician clinicians only if made using methodologies comparable to and no more stringent than those applied for other medical services, consistent with 45 CFR 146.136(c)(4). The Department confirms that a review conducted in March 2026 found no changes to the CPT codes referenced in the statute, and states that any future CPT code modifications will be addressed through Department regulations.
