KY| Kentucky Department of Insurance Bulletin 2025-05 implements House Bill 210 by clarifying that covered persons may optionally assign out-of-network dental benefits directly to their dental provider using a new Department-created assignment form, under which dental carriers must pay out-of-network dentists directly but may still apply existing out-of-network limitations and allow balance billing, while also imposing clear refund, notice, and revocation rights for patients and outlining insurers’ obligations to accept the form, honor revocations, and educate agents and staff about these requirements.
- Covered persons can voluntarily assign out-of-network dental benefits to their non-participating dentist using the new DOI form, but must be informed that the assignment is optional and that the provider may balance-bill for noncovered amounts.
- Dental providers must notify patients of any credit balance within 30 days and refund overpayments within 30 days of a refund request or carrier payment, and the assignment can be revoked by the patient at any time in writing, effective upon the carrier’s receipt.
- Dental carriers are required to accept the DOI assignment form regardless of network status, pay out-of-network providers directly when instructed, promptly notify providers of any revocation with its effective date, and ensure agents and employees are informed of these new requirements under KRS 304.17C-137.
