Hawaii Insurance Division: Act 110 Expands Notice Requirements for Residential Property Policies Starting Jan. 2026.

HI| The attached Hawaii Insurance Division Commissioner’s Memorandum 2025-6R clarifies the application of Act 110, effective January 1, 2026. Act 110 updates the notice requirements for cancellation or nonrenewal of property insurance policies covering any property used for residential purposes, even if only in part.

  • Act 110 applies to both personal and commercial property insurance policies if any part of the covered property is used for residential purposes—including mixed-use buildings with both residential and commercial units.
  • Properties used exclusively for non-residential purposes are not subject to the amended notice requirements; existing rules continue for such cases.
