Delaware Updates Bulletin No. 138: New ASDS Deadlines and 2027 Price Growth Cap Announced

DE| Delaware Department of Insurance Domestic and Foreign Insurers Bulletin No. 138, revised through March 17, 2026, provides updated guidance for insurers, health service corporations, and managed care organizations subject to Regulation 1322 on how to complete and submit the 2025 Affordability Standards Data Submission (ASDS) template, including revisions to required submission years and associated primary care spend requirements. Any carrier making rate filings for health benefit plans under 18 Del. C. §§ 3342A(a)(3)a. and 3559(a)(3)a. must complete the ASDS annually by line of business, with possible waivers for carriers under 250 members in a segment, expat plans, and student health plans via a waiver request to the Office of Value Based Health Care Delivery (OVBHCD). The Bulletin specifies that for plan year 2027, non-professional price trends for inpatient hospital, outpatient hospital, and other medical services may not exceed 4.75%, using the August 2025 CPI as a proxy for October 2025 due to a federal shutdown. Completed ASDS templates must be submitted with rate filings to OVBHCD by June 15, 2026 for individual and small group business and by September 1, 2026 for large group business, and OVBHCD will evaluate carrier compliance with Regulation 1322 in its annual report.
