Alaska Streamlines Insurance Licensing: SB132 Aligns PBMs, TPAs, and Firms with National Standards

Share

AK| The Alaska Division of Insurance Bulletin B25-09 explains implementation of SB132 effective January 1, 2026, and provides updated licensing and examination guidance for PBMs, TPAs, independent adjusters, designated home state licensing, firm licensing, and alias name usage in Alaska.

Primary Points:

  • PBMs and TPAs are expressly licensed under Title 21, must appoint a licensed compliance officer/DRLP who is exam‑exempt, pay significant application fees ($20,000 PBM, $2,000 TPA), and are subject to full Division examination authority comparable to insurers, including multi‑state exams at their own cost.
  • TPA exemptions are narrowed by repealing prior exempt registration for TPAs representing foreign insurers, requiring anyone performing management services for an admitted insurer to be licensed, and imposing annual certification filings for those that remain exempt, plus quarterly filings for licensed TPAs.
  • SB132 modernizes independent adjuster regulation by enabling reciprocal nonresident licensing based on an updated “home state” definition, allowing Alaska to issue Designated Home State licenses where the resident state does not license independent adjusters, and removing the separate portable electronics adjuster category and some exam requirements for qualified nonresidents.
  • National uniformity updates include renaming the “Health” line to “Accident, Health and Sickness,” authorizing firms to designate one compliance officer per line of authority, dropping the prior requirement for a physically accessible resident‑state business location, and discontinuing the continuing education advisory committee.
  • The Division clarifies how alias‑type records may be used in SBS—distinguishing “Alias,” “Doing Business As/Trade Name,” and “Formerly Known As”—and directs licensing and SB132 implementation questions to named Division contacts.
