NC DOI Issues Revised Disclosure Statement Requirements to Improve Clarity and Accessibility for Residents

Share

NC| The North Carolina Department of Insurance Bulletin Number 26-B-01 announces revised Disclosure Statement requirements for North Carolina continuing care providers under Article 64A and introduces a standardized Disclosure Statement Handbook that all providers must follow for filings on or after April 24, 2026. The Handbook establishes uniform content, organization, formatting, and accessibility standards, clarifies that the Disclosure Statement is a regulatory filing rather than a marketing document, and emphasizes accurate identification of the legal provider entity and consistent use of standardized section titles, tables, and appendices. An illustrative example Disclosure Statement is available as nonbinding guidance, and nonconforming filings after the effective date may be returned for correction, so providers are strongly encouraged to review the Handbook and example before submitting.

Key Points:

  • Clarifies that the Disclosure Statement is a legal, regulatory document (not marketing), must clearly identify the legal provider entity, and must include all required sections and appendices as prescribed
  • Applies to all licensed or permitted continuing care providers and requires compliance with the new Handbook for any Disclosure Statement filed, amended, or refiled on or after April 24, 2026.
  • Standardizes required disclosure content, section titles, financial tables (including Financial Snapshot), and accessibility/readability features to support residents and prospective residents.
